On Jan. 5, Mr. Mohammed Chamin – a Member of the European Parliament and the “rapporteur” on the proposed Carbon Border Adjustment Mechanism (CBAM) in the Parliament’s Committee on Environment, Public health and Food Safety (ENVI) – announced that a draft report on the CBAM proposal had been sent to shadow rapporteurs for discussion. This GT Alert covers the five major changes to the proposed CBAM contained in the draft ENVI Report.

Erik de Bie is an attorney-at-law focused on international trade, customs and VAT matters. Erik counsels clients in European trade, export control, sanctions, customs, VAT and excise duty related matters, including litigation. He concentrates his practice on developing and implementing European savings programs, setting up and restructuring European distribution and supply chains, improving and structuring customs, excise duty and VAT related compliance, and limiting risks and liabilities. Given the developments in European legislation and the needs of his clients, Erik is frequently involved in cross-border matters, including obtaining certification as Authorized Economic Operator (AEO), implementing customs bonded warehouse regimes and counseling on VAT issues.

Erik represented (and represents) many companies before Dutch Tax and Customs Courts, the Dutch Supreme Court, the European Commission, and the European Court of Justice.

Robert represents clients before the European Commission, the Dutch Competition Authority (ACM), the Dutch administrative law courts, and the EU courts in matters relating to cartel defense, abuse of dominance, merger control, and State aid proceedings. Additionally, he represents clients before the Dutch civil law courts on issues relating to antitrust recovery / damages claims, and standard-essential patents and FRAND licensing disputes. Robert also advises clients in relation to antitrust / competition law compliance, and foreign direct investment (FDI) / national security regimes.
