Food Labeling: President Issues Executive Order on ‘Made In America’ Labeling 🌾
On March 13, 2026, President Donald Trump issued Executive Order 14392, “Ensuring Truthful Advertising of Products Claiming to Be Made in America,” which directs the Federal Trade Commission to “consider issuing proposed regulations” that would deem an online retailer’s failure to establish procedures to verify country of origin claims “an unfair or deceptive act or practice under the Federal Trade Commission Act.” The order further directs “all agencies with oversight of country-of-origin labeling” to consider promulgating regulations to incentivize the voluntary use of the “Made in America” label for American products. Additionally, the order tasks agencies with periodically reviewing products purchased via government procurement contracts to ensure correct use of the “Made in America” label and directs the agencies to refer to the Department of Justice any contractor or vendor using incorrect labels.

Packers and Stockyards Act: AMS Delays Effective Date Poultry Grower Payment Systems Final Rule
On March 18, 2026, the Agricultural Marketing Service (AMS) published in the Federal Register a proposed rule (91 FR 12936) delaying from July 1, 2026, until December 31, 2027, the effective date of the agency’s Poultry Grower Payment Systems and Capital Improvement Systems final rule, issued in January 2025. AMS states that it is delaying the rule “to allow time for further consideration of possible actions that may be taken regarding the disposition of the rule.” The proposed rule is available for public comment until April 17, 2026 (AMS-FTPP-22-0046). Local Agricultural Policy: Florida Passes State Farm Bill
On March 23, 2026, Florida Governor Ron DeSantis signed into law Senate Bill 290 (PDF), known as the Florida Farm Bill, which becomes effective July 1, 2026. Among numerous provisions, the law

  • “Prohibits a county or municipality from enacting a local policy to restrict the use of gasoline-powered farm or landscape equipment,”
  • “Prohibits local governments from requiring an agricultural property owner to obtain a rural event venue permit or license for an agritourism activity,”
  • “Establishes the Farmers Feeding Florida Program and restricts Feeding Florida from allowing an opposed candidate for elective office to host a food distribution event,”
  • Allows the Florida Department of Agriculture and Consumer Services “to reorganize itself upon approval of the commissioner,” and
  • “Requires the Department of Environmental Protection (DEP) to determine whether any state-owned conservation lands are suitable for bona fide agricultural purposes, allows DEP to surplus such lands, requires the department to retain a rural-lands-protection easement for all such lands, and requires proceeds from the sale of such lands to be deposited into the Incidental Trust Fund within the department.”

Food Policy: Tennessee Passes Law Prohibiting Synthetic Dyes in School Foods
On March 25, 2026, Tennessee Governor Bill Lee signed into law S.B. 2423 (PDF), which amends the Tennessee School Nutrition Standards Act (Tenn. Code Ann. § 49-6-2308) to prohibit schools “from selling, offering for sale, or providing to students on school property through a school nutrition program any food or beverage item that contains one or more of the following petroleum-based synthetic dyes: Allura Red AC; Erythrosine B; Tartrazine; Sunset Yellow FCF; Erioglaucine disodium salt; Indigo carmine; or Fast Green FCF.” Previously, the law only listed as a prohibited substance Allura Red AC, also known as Red 40. While the law became effective upon the governor’s approval, the compliance date for covered schools is August 1, 2027.

Food Policy: FDA Delays Dates of Certification Exemption for Spirulina, Beetroot Red
On March 24, 2026, the U.S. Food and Drug Administration (FDA) published in the Federal Register two rules delaying the effective date of two previous final orders exempting from certification the color additives spirulina (91 FR 13966; 91 FR 5291) and beetroot red (91 FR 13965; 91 FR 5295). According to the publications, Obelisk Tech Systems Inc. submitted objections and a request for a hearing on the spirulina exemption (FDA-2024-C-3384) and GMO/Toxin Free USA submitted objections to the beetroot red exemption (FDA-2024-C-1085). FDA states that the “delay of the effective date of the final order does not reflect a change in our determination that there is a reasonable certainty of no harm from the use of this color additive under the proposed conditions of its intended use” and that these “notification[s] do[] not constitute a determination that all of the issues raised in the submission[s] constitute objections or that a hearing is justified on any objections or requests for hearing that have been filed.” See also ALWR—Feb. 18, 2026, “FDA Publishes Enforcement Discretion Letter for ‘No Artificial Color’ Labeling Claims.”

Nutrition Programs: SNAP Recipients File Complaint Alleging ‘Food Restriction’ Waivers Violate Administrative Procedure Act
On March 11, 2026, several Supplemental Nutrition Assistance Program (SNAP) recipients filed in the U.S. District Court for the District of Columbia a complaint alleging that the U.S. Department of Agriculture (USDA) acted in violation of the Administrative Procedure Act by approving twenty-two “food restriction” waivers, which allow individual states to restrict the purchase of soft drinks and candy under SNAP. Aragon v. Rollins, No. 1:26-cv-00861. The complaint states that, under the statute authorizing SNAP, “the Secretary of Agriculture is authorized to approve ‘pilot or experimental projects designed to test program changes’ to ‘increase the efficiency’ of SNAP and ‘improve the delivery’ of benefits to eligible households.” Such projects “must serve one of four permissible purposes: (1) improving program administration; (2) increasing the self-sufficiency of SNAP recipients; (3) testing innovative welfare reform strategies; or (4) allowing greater conformity with the rules of other programs.” The plaintiff SNAP recipients argue that “[t]he waivers do not satisfy the statutory criteria for pilot projects” and that the “food restriction” waiver “approval letters do not identify how the waivers serve any of the four permissible statutory purposes.” The complaint argues, “By approving twenty-two so-called ‘food restriction’ waivers, Defendants have authorized states to narrow the statutory definition of ‘food’ haphazardly without statutory authority or evaluation methodology, and without notice to or input from the people or businesses directly affected.” See also ALWR—Mar. 11, 2026, “USDA Approves Four More SNAP Restriction Waivers, Twenty-Two States Now with Waivers.”

Antitrust: Iowa, Missouri Producers File Class Action Fertilizer Price-Fixing Complaints
On March 13, 2026, and March 23, 2026, two separate class action complaints were filed in the U.S. District Court for the District of Colorado and the U.S. District Court for the Western District of Missouri alleging that six large fertilizer companies—Mosaic, Nutrien, CF Industries, Koch, Yara, and Canpotex—conspired from at least January 2021 to reduce the supply and inflate the price of nitrogen, phosphorus, and potassium fertilizers.  The Colorado district court class action complaint was filed by a farm in Hopkinton, Iowa (Union Line Farms, Inc. v. Mosaic Company, No. 1:26-cv-01043) and the Missouri district court class action complaint was filed by a farm in Centralia, Missouri (Jason Buckman Farms, LLC v. Canpotex Limited, No. 2:26-cv-04063).
