Industrial Hemp: Eighth Circuit Holds Arkansas Hemp Law Not Preempted by 2018 Farm Bill, Vacates Preliminary Injunction 
On June 24, 2025, the U.S. Court of Appeals for the Eighth Circuit issued an opinion vacating the district court’s preliminary injunction and holding that the 2018 Farm Bill does not preempt Arkansas Act 629, which “criminaliz[ed] many . . . hemp products,” but specifically “does not prohibit the continuous transportation through Arkansas of [hemp].” Bio Gen LLC v. Sarah Huckabee Sanders, No. 23-3237. The court determined that the 2018 Farm Bill’s “text does not support Bio Gen’s claim that Congress intended to ‘federally protect hemp’ and coercively mandate nationwide legality,” but “shows only that Congress wanted to facilitate state legalization of hemp, if a state wants to.” Additionally, the court found that the Farm Bill’s “plain meaning . . . shows Congress intended to forbid Arkansas from prohibiting the transportation or shipment through Arkansas of hemp legally produced in another state,” which, “[t]he plain text of Act 629,” the court stated, “would do exactly that.” According to the opinion, “[t]he district court found the term ‘continuous transportation’ ambiguous because it is unclear if Act 629 would ‘subject’ an out of state teamster ‘to criminal liability when stopping for gas or staying overnight before reaching the final destination outside of Arkansas.’” But the circuit court found that the term “‘continuous transportation’ . . . is well-defined in federal constitutional case law,” stating, “The United States Supreme Court has said that a ‘temporary pause’ does not remove a shipment from continuous interstate commerce: as long as there is a ‘practical continuity of movement’ the goods remain in the stream of interstate transportation.” See also ALWR—Sept. 18, 2023, “Industrial Hemp: Federal Court Issues Injunction Against Arkansas Law Prohibiting ‘Synthetic’ Hemp Products.”
National Agricultural Policy: USDA Announces USDA Department Reorganization Plan
On July 24, 2025, the U.S. Department of Agriculture (USDA) Secretary issued a memorandum authorizing and directing the USDA Department Reorganization Plan. Also announced by USDA, the memorandum states that “USDA will relocate much of its Agency headquarters and [National Capital Region (NCR)] staff from the Washington, D.C. area to five hub locations”: (1) Raleigh, North Carolina, (2) Kansas City, Missouri, (3) Indianapolis, Indiana, (4) Fort Collins, Colorado, and (5) Salt Lake City, Utah. Additionally, “USDA will maintain two additional core administrative support locations: Albuquerque, New Mexico and Minneapolis, Minnesota” and “maintain critical service centers and laboratories including agency service centers in St. Louis, Missouri; Lincoln, Nebraska; and Missoula, Montana.” USDA states that, “[a]t the conclusion of implementation,” the agency aims “to retain no more than 2,000 employees within the NCR.” The memorandum also explains USDA’s plans for its NCR facilities, stating that the agency will ultimately vacate the South Building, Braddock Place, the Beltsville Agricultural Research Center, and the George Washington Carver Center, and that USDA will retain the Whitten Building, Yates Building, and the National Agricultural Library.
Food Policy: FDA, USDA Publish Request for Information on ‘Ultra-Processed Foods’ Definition
On July 25, 2025, the U.S. Food and Drug Administration (FDA) and the U.S. Department of Agriculture (USDA) published in the Federal Register a notice (90 FR 35305) requesting information to help the agencies “develop a uniform definition of ultra-processed foods.” Also announced by FDA, the notice requests information on several issues regarding ultra-processed foods (UPF), including the following:
- “What types of ingredients might be used to characterize a food as ultra-processed?”
- “To what extent, if any, should the relative amount of an ingredient used in a food influence whether the food should be characterized as ultra-processed?”
- “What physical, biological, or chemical processes might be used to characterize a food as ultra-processed?”
- “What, if any, other processing-related techniques should or should not be used to characterize a food as ultra-processed?”
- “Is the term ‘ultra-processed’ the best term to use, or is there other terminology that would better capture the concerns associated with these products?”
- “What other attributes, such as energy density or palatability, might be used to characterize a food as ultra-processed?”
The notice is available for public comment until September 23, 2025 (FDA-2025-N-1793).
Pesticides/Herbicides: EPA Proposes Approval for Three Dicamba Products, Seeks Comment
On July 23, 2025, the U.S. Environmental Protection Agency (EPA) published a memorandum announcing that the agency had received applications from Bayer, BASF, and Syngenta for new dicamba products and opening for public comment EPA’s Memorandum Supporting Proposed Decision to Approve Registration for the Uses of Dicamba on Dicamba-Tolerant Cotton and Dicamba-Tolerant Soybean (EPA-HQ-OPP-2024-0154). Additionally, EPA has published a Draft Ecological Risk Assessment and Biological Evaluation, Human-Health Risk Assessment, and Benefits Assessment for dicamba. According to the memorandum, “EPA has not identified any . . . risks of concern for potential human health exposure” or “for aquatic invertebrates, fish, or aquatic plants.” However, the agency has “identified on-field chronic risk to terrestrial invertebrates, mammals, and birds and acute risk to on-field birds and aquatic-phase amphibians” and “low risk for . . . bees from the proposed uses of dicamba.” Notably, EPA has “identified on-and off-field risks of concern for non-listed terrestrial and wetland plants, and aquatic non-vascular plants,” “includ[ing] the potential for dicamba to volatilize in certain conditions and damage . . . ornamental gardens, desirable trees, or a neighbor’s soybean field if not planted with seed with the dicamba tolerant trait.” EPA states, “The impacts of offsite movement of dicamba to non-users may be substantial. High value crops may suffer yield and quality losses, organic growers could lose organic certification, research and crop breeding programs could be disrupted, and plantings in residential areas and landscapes could be damaged.” To accommodate these risks, EPA has also proposed several mitigation measures for dicamba, although EPA states that “these proposed mitigation measures would not address potential population-level effects to some listed plants and obligates to plants.” The docket is available for public comment until August 22, 2025. Biotechnology: APHIS to Stop Preparing NEPA Analysis for Petitions Seeking GE Nonregulation
On July 9, 2025, the U.S. Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) announced (PDF) that “it will no longer prepare a [National Environmental Policy Act (NEPA)] analysis to accompany its review of petitions seeking . . . nonregulated status” for genetically engineered plants and seeds. According to the announcement, the agency “has no ability under the . . . [Plant Protection Act] to consider or mitigate environmental impacts once it has determined that the modified organism does not pose a greater plant pest risk relative to an appropriate comparator and thus not subject to the regulations at 7 C.F.R. part 340.” APHIS states that, while it “has historically assessed the environmental impacts of granting petitions for nonregulated status as part of its petition process, the agency’s practice of conducting NEPA analysis does not mean it is, in fact, obligated to conduct a NEPA analysis,” and that, going forward, “once APHIS determines through the petition process that a modified organism does not pose a greater plant pest risk relative to an appropriate comparator, APHIS must deregulate the modified organism and does not have authority to consider or mitigate environmental impacts.”
Technology: Federal Court Denies Motion to Compel Discovery of Deere’s ‘Dealer Financial Analysis’ in Antitrust Service ADVISOR Case
On July 7, 2025, the U.S. District Court for the Northern District of Illinois issued an opinion and order denying the Federal Trade Commission’s (FTC) motion to compel discovery of Deere’s “Dealer Financial Analysis (DFA),” the company’s “most comprehensive record of dealer profitability,” in an antitrust case challenging the company’s limited distribution of its Service ADVISOR repair tool. Federal Trade Commission v. Deere & Company, No. 3:25-cv-50017. According to the opinion, Deere’s DFA contains “a consolidated spreadsheet marrying total revenues on parts sales and repair services, customer end pricing, operating returns on each revenue stream, market share, cost absorption, incentives received directly from Deere, and other key financial metrics,” which, in sum, is capable of “automat[ing] many of the same analyses the Plaintiffs’ opinion witnesses will likely generate in litigation.” However, the court noted that “Deere freely produced transaction-level data on dealer financial performance and aftermarket incentives while refusing to produce any portion of the DFA.” The court found that requiring Deere to produce the DFA “would be cumulative and duplicative,” which is contrary to the Federal Rules of Civil Procedure, stating, “[T]he Court won’t subject Deere to even the minimal burden of producing DFA data that adds no real value when Deere has essentially already produced the information. Animal Welfare: Switzerland Requires Labels for Products from Animals Without Anesthesia
On May 28, 2025, the Swiss Federal Council, Switzerland’s seven-member “highest executive authority” issued a press release (English PDF) announcing that the Council was implementing Motion 20.4267 (English PDF) and amending the country’s Ordinance on Foodstuffs and Utility Articles to require labeling for meat, eggs, and milk “if they come from animals that have undergone certain painful procedures without anesthesia.” According to the press release, the following products are subject to the requirements:
- “beef from animals that have been dehorned or castrated without anesthesia,”
- “pork from animals that have undergone tail docking, tooth removal, or castration without anesthesia,”
- “eggs and meat from poultry subjected to beak trimming without anesthesia,”
- “milk from cows subjected to dehorning without anesthesia,”
- “frog legs obtained without stunning the animal,” and
- “liver and meat of geese and ducks resulting from force-feeding.”
The Federal Council states that the “declaration requirement applies to all commercial establishments offering the foods in question, such as restaurants, small businesses, or retail outlets.” The press release states that the requirements became effective July 1, 2025, “with a two-year transition period.”
