Dairy Policy: HPAI Testing Not Required for Dairy Cattle from Unaffected States 🌾
On April 27, 2026, the U.S. Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) announced that the agency had issued an updated guidance document (PDF) on an April 2024 Federal Order, which required testing of lactating dairy cattle before interstate movement. According to the announcement, “effective immediately, lactating dairy cattle moving interstate from States with Unaffected State Status under the National Milk Testing Strategy (NMTS) are no longer required to be tested for highly pathogenic avian influenza (HPAI) H5N1 prior to movement.” As of May 2, 2026, forty-two states are listed as “Unaffected” on the NMTS website—California and Idaho are listed as “Affected” while Florida, North Carolina, North Dakota, and Oregon are listed as “Provisional Unaffected.”

Ag-Gag Statutes: Eight Circuit Affirms District Court, Upholds Iowa Trespass Law in ‘As Applied’ Appeal
On April 23, 2026, the U.S. Court of Appeals for the Eighth Circuit issued an opinion holding that Iowa Code § 727.8A, which “imposes enhanced penalties for recording while trespassing,” as applied to the appellant advocacy group’s “alleged conduct does not violate the First Amendment.” Iowa Citizens for Community Improvement v. Kimberly Reynolds, No. 25-1750 (Animal Legal Defense Fund v. Reynolds, S.D. Iowa No. 4:21-cv-00231).  The advocacy group, Iowa Citizens for Community Improvement (ICCI), argued that “the statute’s prohibition against using cameras while trespassing chills [its] members’ speech when applied to prevent them from recording on private property that is otherwise open to the public after being asked to leave but not to stop recording.” However, the court noted that “the Supreme Court ‘has never held that a trespasser may exercise general rights of free speech on property privately owned and used nondiscriminatorily for private purposes’” and stated, “Iowa has an important government interest in protecting its citizens’ property and privacy rights.” The court rejected ICCI’s proposition that “Iowa’s interests in protecting property and privacy rights are not implicated when the locations at issue are otherwise open to the public,” stating that, “property owners forfeit neither their right to exclude nor to control their property by opening it to the public for a certain purpose.” The court further reasoned that “[w]hen a property owner uses his ‘power to exclude’ by ejecting a trespasser . . . he necessarily exercises his lesser right to stop the trespasser from unlawfully recording on his property.” The court affirmed the district court’s judgment, stating that ICCI’s “members’ recordings implicate Iowa’s important state interest in protecting owner’s property and privacy rights . . . [which] would be served less effectively without the statute, and the statute does not proscribe substantially more speech than necessary to achieve Iowa’s legitimate ends.” See also ALWR—Apr. 29, 2025, “Federal Court Upholds Iowa Trespass Law in ‘As Applied’ Challenge.”

Agricultural Labor: Supreme Court Grants Certiorari to Determine Article III Court Hearing Requirement for H-2A Job Contract Violations
On April 27, 2026, the U.S. Supreme Court granted certiorari in a case appealed from the U.S. Court of Appeals for the Third Circuit, which held that employers alleged to have violated H-2A job contract conditions are entitled to Article III court adjudication instead of only receiving an administrative hearing. Dep’t Labor v. Sun Valley Orchards, No. 25-966. The court will decide the following two questions: 1) “Whether Article III of the Constitution precludes the Department of Labor from adjudicating proceedings to collect monetary remedies from employers who have allegedly violated the terms and conditions of employment of H-2A workers and domestic workers in corresponding employment” and 2) “Whether [the Immigration and Nationality Act (8 U. S. C. §1188(g)(2))] authorizes the Department of Labor to adjudicate proceedings to collect monetary remedies from employers who have allegedly violated the terms and conditions of employment of H-2A workers and domestic workers in corresponding employment.” See also ALWR—Aug. 5, 2025, “Third Circuit Holds H-2A Contract Violations Entitled to Article III Court Hearing.”

Environmental Policy: EPA Publishes Interim PFAS Disposal Guidance
On April 28, 2026, the U.S. Environmental Protection Agency (EPA) published in the Federal Register a notice (91 FR 22815) announcing the availability of an interim guidance document on destruction and disposal of perfluoroalkyl and polyfluoroalkyl substances (PFAS). According to an accompanying fact sheet, the interim guidance features three destruction and disposal technologies which “have a lower potential for environmental release of PFAS compared to other technologies or operating conditions within the categories of storage, underground injection, landfilling, and thermal treatment:” 1) “Underground injection–Permitted Class I non-hazardous industrial or hazardous waste injection wells,” 2) “Landfills–Permitted RCRA Subtitle C hazardous waste landfills,” and 3) “Thermal treatment–Permitted hazardous waste combustors that operate under certain conditions.” The interim guidance document is available for public comment until June 29, 2026 (EPA-HQ-OLEM-2020-0527).

National Agricultural Policy: USDA Announces Food and Nutrition Service Renaming, Program Relocation
On April 30, 2026, the U.S. Department of Agriculture (USDA) announced its intention to rename that Food and Nutrition Service (FNS) as the Food and Nutrition Administration (FNA) and relocate most of its Washington, D.C. staff to various locations across the United States. According to the announcement, “the Supplemental Nutrition Assistance Program will be relocated to Indianapolis, IN; the Child Nutrition Programs will be relocated to Dallas, TX; the Supplemental Nutrition and Safety Programs will be relocated to Kansas City, MO . . . research programs will be relocated to Raleigh, NC . . . [a] fifth Hub in Denver, CO, will serve as the Emergency Management and Continuity of Operations location . . . [and] retailer operations and compliance will be across four offices: Atlanta, GA; Los Angeles, CA; Dallas, TX; and New York, NY.” However, USDA states that “the FNA Administrator will remain in Washington, D.C., along with a small footprint to be responsive to Congress, interagency needs, regulatory work, and policy coordination.”

National Agricultural Policy: USDA Announces Food Safety and Inspection Service Reorganization to Iowa, Georgia
On April 23, the U.S. Department of Agriculture (USDA) announced that it will reorganize the Food Safety and Inspection Service (FSIS) by establishing a new National Food Safety Center (NFSC) in Urbandale, Iowa and a Science Center in Athens, Georgia and “relocate[ing] approximately two-thirds of its National Capital Region workforce” to those locations. According to the announcement, USDA will repurpose existing agency space in Urbandale for the new NFSC, which, USDA states, “will become the agency’s largest office in the United States with approximately 200 employees” and “serve as FSIS’ primary location for headquarters support functions, including resource management, training, food safety education, financial operations, information technology and administrative services.” However, USDA states that “[t]he reorganization does not impact FSIS’ frontline inspection workforce which represents 85 percent of employees and operates across more than 6,800 regulated establishments.” Additionally, USDA states that “the reorganization does not include any reduction in force” and that “[a]ll FSIS employees will retain positions within the agency.”

National Agricultural Policy: USDA Announces Reorganization of Research, Education, Economics Agencies
On April 23, 2026, the U.S. Department of Agriculture (USDA) announced that it will reorganize its Research, Education, and Economics (REE) Mission Area Agencies and published fact sheets on four affected REE agencies: Agricultural Research Service (ARS), Economic Research Service (ERS), National Agricultural Statistics Service (NASS), and National Institute of Food and Agriculture (NIFA). According to the announcement, ERS and NIFA will relocate some Washington D.C.-based positions to Kansas City, Missouri while NASS will relocate some positions to St. Louis, Missouri and ARS “will begin decommissioning the Beltsville Agricultural Research Center (BARC) and relocating research programs to facilities across the country better aligned with regional agricultural needs.” USDA states that, “[a]t this time, the following locations are slated to receive BARC research projects:
