On November 21, 2025, the New Jersey Department of Environment Protection (NJDEP) filed notice with the U.S. District Court for the District of New Jersey that on January 7, 2026, it will move for entry of the Judicial Consent Orders (JCO) with 3M and DuPont and its related companies (the DuPont Entities). NJDEP had previously announced settlements with 3M and the DuPont Entities to resolve state-wide PFAS claims. The State’s filing reports that the combined settlements would provide up to approximately $2.5 billion in value to the State. NJDEP received extensive comments on the settlements during the public comment period and included its response to the comments in the court filing.  More information on the settlements is available on the NJDEP website here and here.  Previously, on November 7, 2025, the court issued a stipulation that allows non-parties consisting of certain municipal utility and sewer authorities, to file amicus briefs in opposition to the motion to approve the settlements.  These briefs are due by December 12, 2025. Other parties may also intervene to oppose the settlements and to date, two parties have filed motions to intervene and more may be coming. Oral argument has been requested.  Stay tuned for updates.
