The Connecticut Department of Energy and Environmental Protection (DEEP) has been busy reissuing its suite of general permits (GPs) for wastewater and stormwater discharges. Despite broad shifts in enforcement priorities across the federal government, the US Environmental Protection Agency (EPA) continues to pursue aggressive enforcement of Toxic Substances Control Act (TSCA) violations. As foreshadowed in EPA’s most recent Unified Agenda, EPA has proposed to add four significant categories of exemptions to the TSCA PFAS Reporting Rule (Rule), citing burdensomeness of the existing Rule. Under the Proposed Rule, these new exemptions would include:
